It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification shall be effective unless agreed by both parties in writing. It is the responsibility of the applicant to notify Deryck Tormey Photography in writing of any changes in circumstances that may affect the photography.
Mark Your Day is a charity project established and run by Deryck Tormey Photography.
Any data submitted by applicants will only be used and stored for the purposes of running Mark Your Day, unless otherwise stated in the entry details. By applying for the project, all applicants consent to the use of their personal data by Deryck Tormey Photography for the purposes of the administration of this charity project and any other purposes to which the applicant has consented, including but not limited to the distribution of personal information to third parties in order to complete the service provided.
Deryck Tormey Photography accepts no responsibility for any applications that are incomplete, illegible, corrupted or fail to reach the Deryck Tormey Photography by the relevant closing date for any reason.
Deryck Tormey Photography attempts to verify each volunteer Photographer’s legitimacy.
Mark Your Day is a voluntary project and as such Deryck Tormey Photography take no legal or ethical responsibility for Photographers who register as volunteers nor liability for their actions.
Deryck Tormey Photography cannot guarantee the ability for a Photographer to be available to each applicant.
All donations are administered through www.iDonate.ie and are distributed to the chosen Charities at the end of the project. The end date of the project can be moved as seen fit by Deryck Tormey Photography.

The applicants agree to take part in reasonable event and post event publicity and to the use of their names, the names of their families and photographs in such publicity.
All image sizes are nominal. The photographer/s will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials, especially man-made fibres. It is sometimes impossible to record digitally or on film the exact colour as seen by the human eye.
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Related Rights Act, 2000. It is contrary to the Act to copy or allow to be copied photographically / electronically or by any other means an image created as part of this contract without the permission of the photographer(s) in writing.
Any complaints should be raised by the applicant with Deryck Tormey Photography, in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.
By entering the project, each applicant agrees to be bound by these terms and conditions.
Mark Your Day is established and operated by Deryck Tormey trading as Deryck Tormey Photography.
These terms and conditions are governed in accordance with the laws of the Republic of Ireland.
BY SUBMITTING THE APPLICATION FORM, THE APPLICANT AGREES TO ALL TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT.
