It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification shall be effective unless agreed by both parties in writing. It is the responsibility of the applicant to notify Deryck Tormey Photography in writing of any changes in circumstances that may affect the photography.
As a Volunteer Photographer for the Mark Your Day project, I agree to the following:
- I understand that Mark Your Day is a charity project established and run by Deryck Tormey Photography.
- I am a volunteer and as such will not receive nor attempt to obtain any compensation, monetary or otherwise, for works carried out. However, all requests by applicants for prints and other additional products will be processed by me and can be monitised.
- Deryck Tormey Photography will attempt to verify my legitimacy as a Photographer and I will aid in any way necessary.
- My application to become a Volunteer Photographer for Mark Your Day does not guarantee me status of same.
- Deryck Tormey Photography reserves the right to refuse my application on any grounds.
- Mark Your Day is a voluntary project and as such Deryck Tormey Photography take no legal or ethical responsibility for Photographers who register as volunteers nor liability for their actions.
- I am responsible for my own actions.
- I am legally responsible for any liability that arises due to my actions.
- I will ensure that when taking photos, privacy of the subjects is respected.
- I cannot advertise myself for the purposes of personal gain under the Mark Your Day brand.
- I cannot offer or provide my services under the Mark Your Day brand without following the correct booking procedure.
- Applicants have agreed or disagreed with the use of their images for promotional purposes by Mark Your day. I must seek additional agreement from applicants for use of their images to promote my own business.
- By applying for the project, all applicants consent to the use of their personal data by Deryck Tormey Photography for the purposes of the administration of this charity project and any other purposes to which the applicant has consented.
- I will adhere to all GDPR regulation.
- Unless superseded by this agreement, I will apply the rules of my businesses’ privacy policy to all Applicants information.
- I grant license to Deryck Tormey Photography to use images for all purposes regarding Mark Your Day without breaching copyright or any agreements I may have made with third parties.
- Deryck Tormey Photography can supply the images to third parties, as long as it is relevant to the work of Mark Your Day.
- Deryck Tormey Photography will do its utmost to credit me but accept no responsibility where accreditation is not made.
- I will reference Mark Your Day when using images through social media.
- Deryck Tormey Photography can use my images to promote the work of Mark Your Day with the understanding that Deryck Tormey Photography can store and use the images in any form of media
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Related Rights Act, 2000. It is contrary to the Act to copy or allow to be copied photographically / electronically or by any other means an image created as part of this contract without the permission of the photographer(s) in writing.
These terms and conditions are governed in accordance with the laws of the Republic of Ireland.
BY SUBMITTING THE APPLICATION FORM, THE VOLUNTEER AGREES TO ALL TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT.
