TERMS AND CONDITIONS:
It is agreed that the following terms set out the total agreement made between the parties and that no
variation or modification of this contract shall be effective unless agreed by both parties in writing. It is the responsibility of the bride and groom to notify Deryck Tormey Photography in writing of any changes in
circumstances that may affect the wedding photography.
1. Booking Fee & Cancellation
The booking fee secures the time and services of the photographer for the wedding and is non-refundable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation.
Cancellation less than 12 weeks before the wedding will result in the payment in full. All cancellations must be in writing. Weddings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time.
2. Special Requests / Coverage
The client understands and accepts that the photographic coverage will be as the photographer’s professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instruction, although every effort is made to comply with the client’s wishes. Any special requests not notified on this booking form must be made by the client to the photographer(s) in writing.
3. Payments
Following payment of the booking fee, balance of fees due are to be paid no later than the wedding day. No photographs will be delivered until all payments due have been paid in full. Payment for albums, prints and / or frames are to be made at time of ordering.
4. Artistic Style
The client acknowledges that it is familiar with the photographers portfolio and is requesting services with the knowledge of the photographer’s style; that the photographer’s work is constantly evolving; that the
photographer’s services are unique and artistic in nature; that the photos may be different from the
photographs taken in the past and that in creating the photos, the photographer shall use his personal
judgement to create images consistent with his personal vision of the event, which vision may be different
from the clients’. Accordingly, the client acknowledges that the photos shall not be subject to rejection on the basis of taste or aesthetic criteria.
5. Retouching
Retouching, digital manipulation and artist finishing is available to the client for free on a selected amount of photographs, in colour, black & white and/or other styles.
6. Images
All image sizes are nominal. The photographer/s will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials, especially man-made fibres. It is sometimes impossible to record digitally or on film the exact colour as seen by the human eye.
Negatives / raw and all digital files remain the property of the photographer.
7. Copyright
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Related Rights Act, 2000. It is contrary to the Act to copy or allow to be copied photographically / electronically or by any other means an image created as part of this contract without the permission of the photographer(s) in writing.
8. License
The photographer(s) shall be granted complete artistic license including in relation to the poses photographed and the locations used. The Photographer’s judgment regarding the locations/poses and number of images taken shall be deemed correct and final. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.
9. Force Majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
10. Attendance
In the unlikely event of the assigned photographer being unable to attend your wedding due to unforeseen circumstances, Deryck Tormey Photography reserves the right to appoint another photographer to attend your wedding on our behalf to undertake the wedding photography to his/her best ability.
11. Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
12. Complaints
Any complaints should be raised by the client with the photographer(s), in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.
13. Booking Fee & Signature
A non-refundable booking fee of €200 is initially required upon signing this contract to secure your wedding date. This fee is deducted (in full) from your package total as outlined in your invoice. Remaining balance is due on or before your wedding day.
I have read the above terms and conditions and agree to abide by the terms of agreement set out in it. I understand that the terms of this agreement cannot be changed unless agreed by both parties in writing.
BY SIGNING THIS CONTRACT, ALL PARTIES AGREE TO ALL TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT, INCLUDING THE NON-REFUNDABLE NATURE OF THE RESERVATION RETAINER AND ALL OTHER PAYMENTS MADE.
